Actions from BOD meeting January 19, 2012
- Accepted year end financial reports subject to audit.
- Directors selected Kyle Braddock to represent the directors on the Executive Committee
- Received membership report of 887 Primary members and 128 Secondary. February membership report will reflect those members terminated/dropped for non-payment of 2012 dues.
- Approved Josh, Karla, Bob Snyder and Alice Kurtz to represent PAAR at the NAR Regional 11 conference in Scottsdale February 29th-March 2nd.
- Karla reported that AAR has appointed her as AE representative to the AAR Board of Directors for 2012.
- Governmental Issues committee to have our GAD send out a report on AAR REALTOR day at the capitol and will be promoting attendance at the AAR Mid Winter Conference here in Prescott in March.
- MLS Committee: Approved agreement with Corelogic for Revenue Share Agreement that will assist us with getting the HUD Short Sale Assistance Desk (SSAD). Received report on RPR and AAR working on enhancement for commercial brokers. RPR has a major commercial release scheduled for mid-year.
- Professional Education Development – scheduled of upcoming classes included in this newsletter.
- Public Relations – Raffle winners are Bob Synder, Rehab Boswell, Josh Lethbridge & Pattie Ferguson. Each won 2 tickets to the Arizona Centennial Celebration being held at Tim’s Center on February 14th.
- Vision Planning – approved new vision statement of “Advocate, Education and Serve to Protect Property Rights”
Issues of Interest to REALTORS®
January 10th we all had the opportunity to spend time at the state capitol visiting with our legislators and hearing AAR’s plan of action for the upcoming legislative session. Unfortunately, only a few members of PAAR took advantage of this, no cost, opportunity to participate in the AAR sponsored REALTOR Day at the Capitol. Hopefully, more PAAR members will attend the AAR Mid Winter Conference that will be held here in Prescott, at the Resort in March. That meeting will include a current update of state level legislative issues of interest to REALTORS.
REALTOR® DAY
After the pledge Tom Farley introduced the issues of interest that AAR would be tracking. They included:
- Anti-deficiency – Nothing has yet been introduced that would affect current law but the idea of repealing or modifying existing anti-deficiency protection has been touted as a way to avoid future financial/real estate meltdowns. AAR opposes any changes to the current law.
- Homeowner Rebate Affidavit – Currently many homeowners are unaware that their residential property taxes are lowered by a payment made from the state general fund directly to the county in which the property is located. This payment is made for residential property in class three of the property tax code, which generally includes owner-occupied primary residences. Under the new law, which goes in to effect this year, the process of receiving the rebate is complicated by requiring the homeowner to go through the cumbersome process of signing an affidavit stating, under prejudice of perjury, that they or a relative live in the home. If a homeowner misses the date to file the affidavit, their property will automatically be reclassified to a class four property and will experience the corresponding increase in property taxes. The legislation creates a paperwork bureaucracy impacting 1.8 million residential properties and increases cost to county governments. AAR is encouraging legislators to repeal the problem legislation.
- Short Sale Anti-deficiency Protection – A bill is being introduced to extend existing anti-deficiency protection to individuals who short sale property. Specifically, the bill stipulates that once a lender has agreed to a short sale price, the lender is prohibited from pursuing a deficiency or deficiency judgment. AAR supports this effort.
County Permit Requirements
Historically, structure type, use and value have determined the level of review needed for projects/construction that requires a permit in unincorporated Yavapai County. Because of the confusion regarding calculation of value as it relates to square or linear footage for a specific structure, staff has proposed and the Board has endorsed the proposal and has directed staff to pursue a potential Zoning Ordinance Amendment that would eliminate all reference to value and adhere to a set square or linear footage limit for permit requirements. The changes would establish a 200 square foot limit on buildings and a 50 linear foot limit on fencing. The matter is scheduled to be heard at the Planning and Zoning meeting in Prescott at 9:30 am on February 8th.
Central AZ Partnership
This is an organization that was formed by local business folks who felt that not all sides of contemporary issues was being heard by the public. The organization’s goal is to inform and educate local citizens on issues of interest and importance within their communities. It has been operating for a number of years in the central Yavapai County area. PAAR is partnership sponsor of CAP and as such ALL members of PAAR are members of CAP. Cap sponsors informative meetings throughout the year that are open to members. Information regarding such meetings is always highlighted in PAAR news info. Watch for the next such meeting and consider attending. You will be better informed and the interests of REALTORS will become better known to local business and governmental leaders.
